第1条（適用）
この利用規約（以下「本規約」といいます）は、本アプリケーション「IROTSUNA（いろつな）」（以下「本サービス」といいます）の利用条件を定めるものです。ユーザーの皆さまは、本規約に同意した上で本サービスをご利用ください。本サービスのご利用を開始した時点で、本規約に同意したものとみなします。
第2条（定義）
本規約において、以下の用語は各々以下の意味で用いるものとします。 （1）「本サービス」とは、当運営が提供するAIぬり絵生成・交流アプリケーション「IROTSUNA」をいいます。 （2）「ユーザー」とは、本規約に同意の上、本サービスを利用する個人をいいます。 （3）「コンテンツ」とは、本サービスを通じて生成または投稿される画像、テキスト、その他一切のデータをいいます。 （4）「プレミアムプラン」とは、月額料金を支払うことで追加機能を利用できる有料サービスをいいます。 （5）「生成クレジット」とは、ぬり絵を生成するために消費するポイントであり、月次付与分および個別購入分があります。 （6）「生成プロンプト」とは、ユーザーがAI生成機能に入力するテキスト指示および参照画像をいいます。 （7）「AIサービス」とは、当運営がぬり絵線画の生成に使用するBlack Forest Labs（BFL）社のFLUX AIサービスをいいます。
第3条（利用資格・年齢制限）
1. 本サービスは13歳以上の方を対象としています。13歳未満の方は本サービスを利用できません。 2. 18歳未満のユーザーが本サービスを利用する場合は、保護者の同意が必要です。 3. 本サービスの利用にあたり、ユーザーはApple IDを用いた認証を行う必要があります。 4. 以下のいずれかに該当する場合、当運営は利用登録を承認しないことがあります。 ・虚偽の情報を申告した場合 ・本規約に違反したことがある者からの申請である場合 ・年齢要件を満たしていない場合 ・その他、当運営が利用登録を適当でないと判断した場合
第4条（AIぬり絵生成サービスについて）
1. 本サービスは、ユーザーが入力した生成プロンプトを基に、Black Forest Labs（BFL）社のFLUX AIを通じてぬり絵の線画を生成します。 2. 【外部APIへのデータ送信】ユーザーが入力した生成プロンプト（テキスト）は、ぬり絵生成処理のためBlack Forest Labs社のサーバーに送信されます。送信されたデータの取扱いはBlack Forest Labs社のプライバシーポリシーに従います。 3. AI生成の性質上、同一の入力であっても毎回異なる結果が生成される場合があります。当運営は、生成結果の品質・内容・完全性・目的適合性について保証しません。 4. 生成に使用された「生成クレジット」は、生成処理を実行した時点で消費されます。生成結果の出来・不出来、APIエラー等にかかわらず、消費されたクレジットは返還されません。 5. 【AI生成物の著作権について】現行の著作権法において、純粋にAIが自律的に生成したコンテンツは著作権法上の保護を受けない可能性があります。ユーザーが創作的な関与（プロンプトの工夫等）を行った場合はその限りではありませんが、当運営はAI生成物の著作権の帰属について保証しません。 6. 本サービスで生成された画像は、個人の趣味・印刷目的での利用は自由に行えます。商業目的での利用（販売・広告への使用等）を行う場合は、第三者の権利侵害がないかをユーザー自身の責任で確認してください。 7. 【禁止プロンプト】以下の内容を含む生成プロンプトの使用を禁じます。 ・特定の実在する個人の容姿・肖像を指示する内容 ・第三者の著作物（キャラクター・ロゴ等）の無断複製を意図した内容 ・性的・暴力的・差別的・反社会的な描写を指示する内容 ・犯罪を助長・美化する内容 ・その他当運営または第三者の権利・利益を侵害する内容
第5条（料金・決済）
1. 本サービスには無料機能と有料機能があります。無料ユーザーには初回限定の生成クレジットが付与されます。 2. プレミアムプランの月額料金は370円（税込）です。価格は予告なく変更される場合があります。 3. 生成クレジットのパック販売価格は、別途表示する料金に従います。 4. 決済はApple App Storeを通じて行われ、Apple App Storeの利用規約および決済ポリシーが適用されます。 5. プレミアムプランは自動更新型サブスクリプションです。解約しない限り、毎月自動的に更新・課金されます。 6. 生成クレジット（追加購入分）は消耗品です。購入後の返金は、各ストアのポリシーに従います。
第6条（サブスクリプションの解約）
1. プレミアムプランの解約は、iOSの設定アプリから行ってください。 「設定」→ お名前 →「サブスクリプション」→「IROTSUNA」→「サブスクリプションをキャンセルする」 2. 解約は、次回の更新日の24時間前までに行う必要があります。解約後も、有効期間終了まではプレミアム機能を引き続きご利用いただけます。 3. プレミアムプランを解約すると、次回の更新日以降、生成上限が無料プランの枚数に戻ります。
第7条（ユーザーコンテンツと知的財産権）
1. ユーザーが本サービスを通じて投稿した作品（塗り絵写真等）の著作権はユーザー本人に帰属します。 2. ユーザーは、本サービスへの投稿コンテンツについて、当運営がサービスの提供・改善・宣伝のために使用することを、無償で許諾するものとします。 3. 本サービスのロゴ・デザイン・商標等の知的財産権は当運営に帰属します。無断転用・複製を禁じます。
第8条（禁止事項）
ユーザーは本サービスの利用にあたり、以下の行為を行ってはなりません。 【一般的な禁止事項】 （1）法令または公序良俗に違反する行為 （2）犯罪行為に関連する行為 （3）他のユーザーを誹謗中傷し、名誉を傷つける行為 （4）特定の個人を識別できる個人情報を投稿する行為 （5）性的・暴力的・差別的コンテンツを生成または投稿する行為 （6）著作権・商標権その他の知的財産権を侵害する行為 （7）本サービスのシステムに不正アクセスまたは過度な負荷をかける行為 （8）他のユーザーになりすます行為 （9）スパム・広告・勧誘目的の投稿・コメントを行う行為 （10）未成年者に有害な情報を提供する行為 【AI生成機能に関する禁止事項】 （11）実在する特定の個人（芸能人・政治家・一般人等を含む）の容姿や肖像を指示するプロンプトの使用 （12）他者の著作物（キャラクター、ロゴ、絵画等）の無断複製を意図したプロンプトの使用 （13）AIを用いてフィッシング・詐欺・偽造に利用可能なコンテンツを生成する行為 （14）生成機能を自動化ツール等で大量実行し、本サービスに過度な負荷をかける行為 （15）その他、当運営または第三者の権利・利益を侵害する行為
第9条（アカウントの停止・凍結）
1. 当運営は、ユーザーが以下の場合に該当すると判断した場合、事前通知なくアカウントを凍結・一時停止できます。 ・本規約に違反した場合 ・不正利用（複数アカウントの作成、生成機能の自動化利用等）が確認された場合 ・第三者の権利を侵害するコンテンツを継続して投稿した場合 ・その他、当運営がサービスの健全な運営に支障があると判断した場合 2. アカウント凍結・一時停止によってユーザーに損害が生じた場合、当運営の責任は第11条（免責事項）の定めによるものとします。
第10条（退会・アカウント削除）
1. ユーザーはいつでも本サービスの設定画面からアカウントの削除（退会）を申請できます。 2. プレミアムプランをご契約中にアカウントを削除した場合、サブスクリプションは自動では解約されません。課金が継続しないよう、「設定」→ お名前 →「サブスクリプション」→「IROTSUNA」から別途解約手続きを行ってください。 3. 退会処理が完了した場合、ユーザーの個人情報（ニックネーム・プロフィール画像・自己紹介文・FCMトークン等）は削除されます。 4. ユーザーが投稿した塗り絵作品・コメントは、コミュニティの継続性を維持するため削除されず、「退会済みユーザー」として匿名化された状態で引き続き掲載されます。これらのコンテンツの削除を希望する場合は、退会前にユーザー自身で削除操作を行ってください。 5. フォロー関係、いいね、セーブ、通知等のデータは退会と同時に削除されます。 6. 退会処理が完了すると元に戻すことはできません。
第11条（免責事項）
1. 当運営は、本サービスの内容・品質について保証しません。本サービスは現状有姿で提供されます。 2. AI生成コンテンツの著作権・商標権等に関するトラブルについて、当運営は責任を負いません。 3. ユーザー間のトラブルについて、当運営は責任を負いません。当事者間で解決してください。 4. 天災・通信障害・システム障害等の不可抗力によるサービス停止・データ消失について、当運営は責任を負いません。 5. サービスの変更・停止・終了によりユーザーに損害が生じた場合でも、当運営は責任を負いません。 6. 本条および本規約の他の規定にかかわらず、当運営の債務不履行または不法行為によりユーザーに損害が生じた場合、当運営に故意または重大な過失がある場合を除き、当運営が負う損害賠償責任は、損害の事由が生じた時点から遡って過去1ヶ月間に当該ユーザーから受領した利用料金の総額を上限とします。
第12条（サービスの変更・停止）
当運営は、ユーザーへの事前通知なく、本サービスの内容を変更または提供を停止することができます。これによりユーザーに損害が生じた場合、当運営の責任は第11条（免責事項）の定めによるものとします。
第13条（個人情報の取扱い）
ユーザーの個人情報は、別途定める「プライバシーポリシー」に従い適切に管理します。
第14条（規約の変更）
当運営は必要に応じて本規約を変更することがあります。重要な変更を行う場合は、アプリ内で通知します。変更後に本サービスをご利用になった場合は、変更後の規約に同意したものとみなします。
第15条（準拠法・管轄裁判所）
本規約の解釈にあたっては、日本法を準拠法とします。本サービスに関して紛争が生じた場合には、当運営の所在地を管轄する裁判所を専属的合意管轄とします。

Article 1 (Application)
These Terms of Use ("Terms") set forth the conditions for use of the application "IROTSUNA" ("Service"). Users must agree to these Terms before using the Service. Commencing use of the Service constitutes acceptance of these Terms.
Article 2 (Definitions)
In these Terms, the following terms have the meanings set forth below. (1) "Service" means the AI coloring generation and community application "IROTSUNA" provided by the Operator. (2) "User" means any individual who agrees to these Terms and uses the Service. (3) "Content" means images, text, and all other data generated or posted through the Service. (4) "Premium Plan" means the paid service providing additional features upon payment of a monthly fee. (5) "Generation Credits" means points consumed to generate coloring images, comprising monthly allocations and individually purchased credits. (6) "Generation Prompt" means text instructions and reference images entered by users into the AI generation feature. (7) "AI Service" means the FLUX AI service by Black Forest Labs (BFL) used for line art generation.
Article 3 (Eligibility & Age Restrictions)
1. This Service is for users aged 13 and over. Users under 13 may not use the Service. 2. Users under 18 require parental consent to use the Service. 3. Users must authenticate using an Apple ID. 4. The Operator may decline registration in any of the following cases. · Submission of false information · Prior violation of these Terms · Failure to meet age requirements · Any other case deemed inappropriate by the Operator
Article 4 (AI Coloring Generation Service)
1. The Service generates coloring line art based on user prompts via Black Forest Labs' FLUX AI. 2. [Data sent to external API] Generation prompts are transmitted to Black Forest Labs' servers and handled according to their privacy policy. 3. Due to the nature of AI, results may differ each time for identical inputs. The Operator makes no warranty regarding result quality, content, or fitness for purpose. 4. Generation Credits are consumed when processing executes. Consumed credits are not refunded regardless of result quality or API errors. 5. [Copyright] AI-generated content may not be protected by copyright law. The Operator makes no warranty regarding copyright ownership of AI-generated content. 6. Images generated through the Service may be freely used for personal and printing purposes. For commercial use, users must independently verify that no third-party rights are infringed. 7. [Prohibited prompts] The following are prohibited. · Prompts specifying the appearance or likeness of real individuals · Prompts intending to reproduce copyrighted works without authorization · Instructions for sexual, violent, discriminatory, or antisocial content · Content that promotes criminal activity · Any content that infringes rights of the Operator or third parties
Article 5 (Fees & Payment)
1. The Service offers free and paid features. Free users receive a one-time generation credit bonus. 2. The Premium Plan monthly fee is $4.99 USD/month. Prices may change without notice. 3. Generation credit pack prices are as separately displayed. 4. Payment is processed through Apple App Store, subject to Apple's terms and payment policies. 5. The Premium Plan is an auto-renewing subscription that charges monthly unless cancelled. 6. Generation credits (additional purchases) are consumable. Refunds are subject to each store's policies.
Article 6 (Cancellation)
1. To cancel the Premium Plan, use the iOS Settings app. Settings → [Your Name] → Subscriptions → IROTSUNA → Cancel Subscription 2. Cancellation must be completed at least 24 hours before the next renewal date. Premium features remain available until the end of the current billing period. 3. After cancellation, the generation limit reverts to the free plan quota from the next renewal date.
Article 7 (User Content & Intellectual Property)
1. Copyright in works posted by users belongs to the user. 2. Users grant the Operator a royalty-free license to use posted content for providing, improving, and promoting the Service. 3. Intellectual property rights of the Service (logos, designs, trademarks) belong to the Operator. Unauthorized use is prohibited.
Article 8 (Prohibited Conduct)
Users must not engage in any of the following. [General] (1) Violating laws or public order and morals (2) Engaging in criminal activity (3) Defaming or damaging the reputation of other users (4) Posting personal information that identifies individuals (5) Generating or posting sexual, violent, or discriminatory content (6) Infringing copyright, trademark, or other intellectual property rights (7) Unauthorized access or placing excessive load on the Service (8) Impersonating other users (9) Spam, advertising, or solicitation (10) Providing harmful information to minors [AI Generation] (11) Prompts specifying the appearance of real individuals (12) Prompts intending to reproduce copyrighted works without authorization (13) Generating content usable for phishing, fraud, or forgery (14) Mass-executing generation via automation tools (15) Any other act infringing rights of the Operator or third parties
Article 9 (Account Suspension)
1. The Operator may freeze or suspend an account without notice if any of the following applies. · Violation of these Terms · Confirmed unauthorized use (multiple accounts, automation, etc.) · Continued posting of content infringing third-party rights · Any case where the Operator determines healthy service operation is impaired 2. For damages from account suspension, the Operator's liability is governed by Article 11.
Article 10 (Account Deletion)
1. Users may delete their account at any time from the Service's settings screen. 2. Deleting your account while subscribed to the Premium Plan does not automatically cancel the subscription. Please cancel separately via Settings → [Your Name] → Subscriptions → IROTSUNA. 3. Upon account deletion, personal information (nickname, profile image, bio, FCM token, etc.) will be deleted. 4. Posted content (coloring works, comments) will remain in anonymized form as "Deleted User" to maintain community continuity. Delete content before withdrawing if you wish it removed. 5. Follow relationships, likes, saves, and notifications are deleted upon account deletion. 6. Account deletion cannot be undone.
Article 11 (Disclaimers)
1. The Operator makes no warranty regarding the Service. The Service is provided "as is." 2. The Operator is not liable for copyright or trademark disputes related to AI-generated content. 3. The Operator is not liable for disputes between users. 4. The Operator is not liable for service interruptions or data loss due to force majeure. 5. The Operator is not liable for damages from Service changes, suspension, or termination. 6. Except in cases of intentional misconduct or gross negligence, the Operator's maximum liability is limited to fees received from the relevant user in the one month preceding the event.
Article 12 (Service Changes)
The Operator may change or suspend the Service without prior notice. Liability for resulting damages is governed by Article 11.
Article 13 (Personal Information)
Users' personal information is managed in accordance with our separately established Privacy Policy.
Article 14 (Changes to Terms)
The Operator may update these Terms as necessary. Significant changes will be announced in the app. Continued use after changes constitutes acceptance of the updated Terms.
Article 15 (Governing Law & Jurisdiction)
These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the court with jurisdiction over the Operator's location.
